The Dade Superior Court's jury trial session is winding down without much courtroom drama. Like last week, there was only one trial this week, and this week's version had the same defendant as last's: Charlie Wooten.
Wooten was on trial this time for possession of methamphetamine, two counts of possession of controlled substances, possession of marijuana, less than an ounce, and theft by receiving stolen property. The two counts of possession of controlled substances were not prosecuted. He was found guilty on all other counts.
For the theft by taking charge, Wooten was sentenced to 10 years plus a $2500 fine. He got three years for the meth and 12 months on the marijuana charge. These are to be served concurrently, and all on probation provided he obeys the conditions set forth by the court.
But Wooten was sentenced to jail time for the counts against him in last week's trial--two years for fleeing/attempting to elude an officer and 12 months each for reckless driving and failure to maintain lane, to be served consecutively.
None of the other cases shortlisted for trial this week went before a jury. Charlie Ford entered a guilty plea and received five years for obstruction of an officer and another five for riot in a penal institution. Those are to be served concurrently. Two lesser counts of battery and simple battery were merged with the more serious charges. Ford may be given credit for time served as determined by his custodians. He had been in jail at the time of these offenses for probation violation subsequent to an earlier battery charge.
Jamie Minor entered a guilty plea to two counts of possession of controlled substances and one of marijuana, less than an ounce, with counts for possession of methamphetamine, hydrocodone and oxycodione not prosecuted. He was sentenced to a total of six years, all to be served on probation, and a fine of $1050.
Clarence Durham pled guilty to possession of methamphetamine and was sentenced to two years, with the first eight months to be served in detention and the remainder on probation.
Two cases against Martha McNabb for various charges, also shortlisted for trial this week, remain pending but a sentencing hearing has been scheduled for Dec. 1.
The case of Danny Hall, who was charged with assault after firing shots when a post-holiday-party out-of-towner ended up on his property late one December night, has been continued, which is to say postponed. Hall's unwelcome visitor, Daniel Snyder, of an Indiana address, faces DUI, open container and theft by taking charges--he was driving somebody else's car on his midnight ride--did not show up for calendar call and is scheduled for a bond forfeiture hearing in February.
The next jury session of Dade Superior Court is in April 2018.
