A lawsuit filed by the brother of a pedestrian killed in 2018 by a Dade County school bus will not, as scheduled, go to trial in Dade Superior Court this April. The lawsuit was settled out of court last month for an undisclosed amount.

Linda Diane Hulgan, 71, of Wildwood, was struck by an empty school bus almost exactly two years ago, on Feb. 20, 2018, while crossing Highway 136 on foot at its main Trenton intersection with Highway 11. She died two days later at Erlanger of injuries sustained in the accident.
Her brother, Roger Hulgan of Cumberland County, Tennessee, filed a civil suit in November 2018 alleging negligence on the part of the bus driver, Angela Payne, and by extension on the part of the county school system.
Court papers list the suit as having reached an impasse at attempted mediation on Dec. 9 of 2019. But then only a month later, on Jan. 21 of this year, the suit was dismissed "with prejudice," meaning that as a condition of whatever settlement the parties reached, the plaintiff may not take the case against the school system back up later.
